I agree with other answers: how did he get the money? We all know to deposit only in an Escrow Account, thus covered by insurance. Contact escrow agent..

Check http://www.makinghomesaffordable.gov and check the fbi in your area under mortgage fraud. Do not waste any time. I am not sure how anyone could still $64,000 unless the property was sold and some how the broker got in title. But if their was fraud I would contact the fbi and hopefully they can help.

If you pull up http://www.makinghomesaffordable.gov will show who toi contact if fraud has happened and what things to avoid that could be foreclosure avoidance scams.

More details are definitely needed. But, if you have a legitimate complaint agains a broker you should contact the California Department of Real Estate and find out what to do.

Call the Police?......................................................................... I think more details are needed like (How did he steal it) and why you were using the Broker (What was he suppose to be doing and how did he end up with $64,000 of your money) You were paying him to do What exactly? (Loan modification..Sell your home?)

Still think the police would be my first call . Depending on what happened would determine your other options.
