New York Has A 90 Day-Notice of Default In Foreclosures. What Happens If A Bank Went By The Old Rule And Only Gave You 30 Days-Notice of Default?

You have to hire a defence attorney who handles foreclosures.
He will have to look into all paperwork before advising you.

Hi Ervin, we are not Lawyers and strongly suggest you seek professional legal advice. In our experience if the rule was broken as here you stated then the bank would be violation of the rules and you may be able to file as such, again an attorney who is experineced with this type of issue would be the one to contact

Ervin that is going to be best answered by an attorney who practices real estate law in NY. Depending on where you are at in teh foreclsoure process it could make them start over or void it. The attorney would be able to gove you proper guidance. You could also check to see if there is a non profit in NY that assist home owners on your situation at no cost. Good luck on working things out.
