I am current with mortgage payments, but am down to only assets being our 401-K's and a car we bought in 2/09 which we owe $20000 on.Florida house has been on the market since 8/08. Bank wants and we will send all the information they want. I contacted an attorney and was advised to stop making mortgage payments, because the bank see me as a prime customer while I am current and won't have any impetus to offer a solution until I'm in arrears. Does this sound like good advice?

Yes, your attorney is giving you good advice. I would be surprised if you have even had a conversation with a decision maker from the lender that holds the note on your property if you have not been delinquent on your payments. Should you miss one or even two payments, the phone will start ringing with a lender representative on the other end eager to speak to you about your current mortgage. It sounds as if you own a residence in the state of FL but you don't specify if it is your primary home or an investment property. Did your attorney raise the question of a Short Sale with you? It's hard to direct you correctly without all of the pieces of the puzzle. Keep asking your questions. This is a very difficult market for sellers. Have you been trying to sell your FL property on your own? If you have a Realtor he/she should have contacted your mortgage holder if everything else has been tried. Is the property priced just below market value? Are there short sales or foreclosures in your area? Has your property value gone down below what you owe on the property? Have you spoken to your mortgage holder? A good Realtor can get thriugh doors by knowing what papers are needed and what questions to ask of the right people.
