I'm looking for information about a company called Green Credit Solutions.

I've been offered a job as a Sales Rep by an affiliate of theirs in Sonoma County to seek out homeowners in need of loan modifications. Supposedly, Green Credit works with DRE "sanctioned" Real Estate attorneys to work directly with the lenders via court orders. I know there are many lossmitigation and loan modification companies out there that are complete scams and I am calling on Real Estate agents with whom I have a great relationship with and I don't want to risk losing their respect by bringing their clients to a company that is not on the up and up. At this moment, there are 2 police cars, and up to a dozen Black Suburbans at the Offices of this company. Employees have been sent away with their boxes, and Curt and Chris are apparently being questioned in their own conference room.

So... local Police, Dept. of Justice, and some from the Bar Association is what I've been told... big DOJ signs on some of those Suburbans.

Did you file a small claims suit? Did you seek recovery from the DRE or State Bar recovery funds?

I can't file a suit for you. But I can say that if out of all of you, you can't find a class action attorney, then the jokes about lawyers aren't true.

Should GCS really be allowed to effectively embezzle trust funds and then quietly move on to the next cash cow?

There are between 30-40 of you. Get an attorney, and I'll email the information to everyone who has contacted me.

Emails and complaints were forwarded to the CA DRE and CA Bar investigators. Now everyone has got to put pressure on the State Attorney General and Governor. The message has to be that this is no.

Just a comment on some of these recent posts...First, I don't believe that "Krista" is a broker, as she claims, if she is the person I think she is. If you are a broker, Krista, please provide us with your CA DRE license #. I think you are someone who is trying to make yourself out to be important...that's fine, but your posts around the internet haven't done a great deal to prevent good, hard working loss mitigation companies from doing their work. The bottom line is every day, we save people from foreclosure, reduce their debt, improve their credit, get them out from under a house they can't afford....whatever it takes. Its hard, tedious work, and while it has its rewards, no one is getting rich here. When we have a complaint, we deal with it, hopefully Roberta from Palm Springs can attest to that. But if she is still having problems with us, Roberta, you have my email. I will personally get to the bottom of your situation.

We work on hundreds of files each month, and they myriad of details and communications we go thru to help our clients is mind-boggling. Our affiliates and clients are welcome ANY TIME to come to our offices and review their files, talk to our staff and get a better understanding of their situation.

As to Joel's comments about the BBB, he is absolutely correct, The CA BBB gives an F rating to companies who perform debt settelment services. It is headed byt a gentleman who makes over $200,000 a year as its President, and runs a "credit counseling" business as well. I would suggest you read about several lawsuits and articles about the BBB...Here are a few:

Tom, the fact that the BBB says they never heard of us is strange, since we have been listed on their website for more than 18 months. 4 of the five reviews are 5 stars...the most recent one to be honest sounds fishy, since he described a situation that could not have taken place, the way we handle our calls.

All said, Tracy, you have probably long sinced either decided to work with us or not....I hope you are on the team, but if not, I hope you are helping your clients with another qualified firm.

To those so-called "watch-dogs" and consumer advocates, please, the banks and regulators are doing a pretty good job screwing up peoples lives all by them selves. They really don't need your help, but if you really want to help people stay in their homes, perhaps you could petition the CA legislature to not pass the HR 94 bill.

Whether you agree that loan mod firms and attorney's should be allowed to charge upfront fees or not, no one can dispute the fact that the banks and lenders are the ones who control most of the marbles here.

The BBB automatically gives all "loan mod" companies an automatic "F" rating, regardless of company history, company standards, procedures, ethics, morals, policies, good works, complaints, etc... Look it up. Green Credit has had a few complaints. Name one company or person out there in this God forsaken world who is trying to do something good for it who doesn't have someone out there wanting to squash them for it. Green Credit has done well over 1,000 loan modifications and over $50 million in payment reductions. They are making a difference for people at the foundation of the crisis. THEY ARE THE GOOD GUYS! People don't seem to ever want to tell you the whole truth. You honestly don't think SOMEONE is going to complain? You could be handing out free ice cream on a hot day and someone will complain about it. I have personally watched GC in action. They are the real deal.

Participants in Green Credit various companies are also involved in many other entities. Reo Profits, Accredit, First Secured Investors. The list goes on and on. If you are an investor who is concerned with your situation Please Please contact the DRE, SEC, CALBAR, ATTORNEY GENERAL. Go with your gut!

The reason she is encouraging complaints to the Association of Realtors is because Erickson is a real estate broker. If you look up the case against Erickson, it involves a large amount. Based on the amount of money involved, she is the biggest victim to date.

In addition to loan modifications and debt management, Green Credit and Erickson were (and likely still are) also involved in investments. The magnitude of investments and disposition of those investments are unknown. But based on their track record of handling trust funds and not delivering on promises, there is cause for concern for all investors who invested money with Green Credit Capital and Erickson. I, myself, was able to download the prospectus and investment docs on 5 LLC investment offerings from an affiliated website that was not password protected. Each investment offering offered involved 15,000 Series A memberships at $1,000 each or a face value of $10,000,000. Each affiliated company utilized finders and paid finder's fees of 3%. The fact that I could access the prospectus and investment docs for each offering off their website without a password or having submitted an investor questionnaire is beyond questionable.

And if she is able to find an attorney who is willing to represent GCS victims in a class action lawsuit, more power to her. I know I would take the time to contact everyone I've been in communication with if an attorney was willing to get involved. The CA Bar has seized the assets, and all GCS victims should be filing a claim on the client security fund. They should also file claims with the CA DRE Real Estate Recovery fund- especially if they have successfully obtained a judgment. It should also be determined whether GCS or any of their officers had E & O or other insurance. It is my understanding that the Accredited lawsuit settlement (which Erickson was named as a prior director) was paid by insurance (but I have to double check).

This is by no means over and will not be over until the officer's professional licenses have been revoked and all financial resources have been drained. From what I can, there layers of affiliated businesses and the business model is simply being replicated under different websites and company names.

There is a substantial amount of research and data available, and the AG's office should be involved as this is just the tip of the iceberg.

Lord only knows what you mean by the statment that YOU may be the largest victim out there. And by requesting other peoples contact info, you may be attempting to continue the problem.

There is NO SUCH THING as a law firm that would be interested in a Class Action suit here, so you are lying right off the get-go. (Class Actions are only against companies that have a potential of assets for payouts, or insurable liabilities) You say someone has " a great amount of data on this..." well who doesn't! Give us a break. Your "heart goes out" is a stupid plea for leads to go get these mod victims back into the loop again, yes?

Your concept of filing a complaint with the Bar is BOGUS because the 'Bar' already has 'court-ordered' possession and control... and your concept of complaining to the REALTOR's Board shows your level of experience and intelligence (or lack of both) in the business.

Gary Erickson Law Group. Green Credit and all the other companies. I want to help you folks out there. You are only one of many many victims as I might be the largest one. Please leave a way of contacting you so I can pass on information or get you in contact with a terrific lawfirm that can do a class action suit and already has a great amount of data on this. Best wishes and my heart goes out to each one of you in this circumstance. There is no evidence Green Credit filed Bankruptcy, however, the Gov't. has set up a hotline with the following message (213-765-1756):

"Please be advised that on Monday, December 21st, 2009 the State Bar of California pursuent to an order from the Orange County Superior Court assumed jurisdiction over the unlawful law practice of Green Credit Solutions also known as the Green Credit Law Center, Guardian Credit Services, Get My Credit Grade, PacWest Funding, Erickson Law Group, MagusGlobal. We have taken possession of all the client files and records from the office. If you believe we have your file, please leave your full name, along with your phone number, your cell phone number if you have one, your address, an email address if you have one and the type of method you would like us to use to return your file. If you would like us to send it by mail, please indicate or if you would like to pick it up in person... um, please leave the appropriate message. Uhh... please allow a little bit of time... to process these files, get 'em into our system and then we will get your file back to you as soon as possible. Thank you for your patience."

I was told by an attorney here in Oregon that I could file a small claims suite but that I would have to do so in CA and that there would be no guarentee that they would show. I can't afford the money it would take to do so. I did file my paperwork with the DRE and have not heard anything. I know by the responses that there are a lot of us, most in CA. I'm hoping still that I could recover my money and that everyone else can as well.

The money is in their pockets and their families pockets. They as good as stold our money. I asked as you suggested Krista, for a copy of where the funds were spent that I paid them and got nothing. I've sent repeated emails as they suggested I do (Fox) but never heard back from him. I've never been one to give up but this is looking like a lost cause. Mkim, they can fool us once but don't let them do it to you again. As Krista has suggested, just work with your current lender.

Krista, do you think we could write off what we paid for a modification on our loans on our taxes? Just a thought...

There was no way of getting that far into the convo after I mentioned about getting my money back.
He kept on reading what they had on their records infront of his computer screen. And how they sent my info to my lender and that if I wanted help with my loan mod that they can stil help me.

I really don't need them to work on my modification. Since my lender kept on stating that they have no documents sent from that company from day 1, why would I trust them again to complete the job? If they did send my documents over, they have the wrong number/dept. It's funny how I can send my own documents to the correct dept and # and have my lender received all docs less than 48 hours.

If you get paid to work on loan mods, maybe they should spend time in locating the correct depts for specific loans and fax #'s also.

No money??!!! What happened to the funds that were held in trust and weren't supposed to be accessed until the modifications were complete? What did they do? Embezzle trust funds?

That money was never supposed to be accessed, and it appears they stole the money.

I have spoken to Chris today....
He stated that the company has no money to pay back/refund their customers.
But he did mention that they can help their customers with their loan modification again and they will do everything in their powers.

People with complaints about Green Credit, aka Guardian Credit, aka mycreditgrade.com, etc. etc. etc. should just call Curt Melone on his cell phone at 310-694-2340, or Chris Fox on his cell phone at 310-547-7501.

I'm sure if you called often enough they would get the picture... I'm sure they would not run away from their obligations. After all, Chris has family to think of, and Curt... well... okay... forget that theory.

I'm a 1st time home buyer w/o any knowledge on who to contact or where to file a complaint regarding this sticky situation. I have filed with the DRE, BBB and CA AG. Hopefully the waiting process for a response back won't take too long. And I appreciate the support from the other victims/supporters. At least i know i'm not alone in this.

Scottfister, some people do things to help others for free. Its called community service- or as Moe Bedard would say, paying it forward.

In this instance, these borrowers paid for modification services and did not receive them. What I am attempting to do is get them the help that they may need to try to help in balancing things out. If you helped 3 people, and I helped 3 people, and so on, it would not be too much work for any one person. Plus, GCS customers would get some relief.

Maybe it would be better if people would post questions about getting a loan mod, questions on the HAMP program and trial period, forbearance, short sale, etc.

I'd also like to know if everyone (in CA) contacted the DRE, CA Bar, and CA AG or if anyone has filed a claim against recovery funds.

I don't see the licensing for ACS listed on the website for any of their services. The site also doesn't identify whether the company is a sole proprietorship, LLC, or corporation. That is always a red flag. The other red flags are debt settlement services and an affiliate program that pays high commissions. There is also no information regarding bonding which is usually required when credit services are performed. Aside from that, they are on ML Implode's trusted list for multiple states, and when I checked them out before, they weren't verifiable based on their website.

I did find an Aces Credit Soluitions LLC that is not in good standing with the State of Illinois. The address on the web registration matches the LLC. Nonetheless, when I go to a website, I expect to be able to verify the identity and licensing of the business in the state the business is located. I shouldn't have to turn into Nancy Drew just to do a simple background check.

I don't see where the company is compliant in each state they are advertising in. I would not do business with the company.

The point is that I asked for volunteers- not merchants.

I didn't mean to be in bad taste. If that's how this was interpreted, my apologies. Most people won't do anything for free, I'm just trying to offer a resource. Good luck in getting your money back. The situations that I have read about and talked to people about that have gone sour are mostly ones that involve people not getting their money back because nothing was done to improve their situation. Our Attorney General in Illinois is notorious for jumping on people and firms that don't do things the right way. The laws in IL are very difficult to navigate. We've spent a considerable amount of time and resources making sure we have the process ironed out with our Attorney. Again, no harm meant in offering information and please I hope it works out. If you do decide to go with another Loan Modification company, I can offer this for advice. Make sure that the contract indicates that money will be required only after services have been rendered. It's the 'up front' money that has hurt people and scarred the reputation of decent firms trying to help people. It appears that is what Green did to their customers, and I am sorry you were part of it.

I am so sorry to hear all the problems that everyone has had with Green Credit Solutions. It is unfortunate that a company like that was allowed to exist and take all this money and not do anything with it. While our company cannot offer free assistance, as Krista has asked for (I understand, we simply cannot handle so many requests from so many people to do this for free), we are an honest, work it to the bone company who processes loan modifications at a fair price. We also offer forensic mortgage audits which we find help in the negotiations if we do find violations. Sorry we cannot offer more than that, but if want to please email me and we will look at your case and determine if we can help you with a modification. GCS Victims:

Please contact the California State Bar and the California Attorney General’s office to file a complaint. This is in addition to the California Department of Real Estate.

Recovery of losses may be possible through the CA Bar’s Client Security Fund. Here is a link to the website page that gives information on the Client Security Fund that includes a link to file a complaint:

The California Department of Real Estate has reached the statutory limits of their authority and cannot assist in obtaining refunds. However, its important to file a complaint against the company.

I completely understand your frustration. I am too and my situation is a bit different since I'm in Oregon. Taking them to court would mean I need to go to CA to do it. I could take them to small claims but their is no guarentee that they would show, I'm guessing they wouldn't. Even though the BBB said they get many complaints it is still important to file with them. I do suggest that you file still with the CA attorney general as well as the CA DRE. You want to make sure that your information is out there too in case we get lucky enough to figure a way to file a class action against them.

I did report them to the BBB. The rep there told me that they have "MANY" complaints on GCS and the company will not get back to me in the end or answer the complaint. The rep also advised me to take them to court on my own. Ok, but with what money? This is soooo frustrating!

This isn't the first time that the CA DRE has put out a desist and refrain out on GCS. They had one earlier during a time that I signed up with GCS but had no idea. I signed up with them back in January and lost $3495. I've been in this dark tunnel for a long time hoping that some type of Class Action will come of this. Have you reported to the BBB and the CA DRE? I suggest you do so that there is some type of record. I also reported to the CA Attorney General.

I believe this Mr. Fox is associated with Fox Fields Financial Corporation based in Beverly Hill, CA and registered in Nevada. I have seen two different "credit repair" re-finance loans wherein Fox Fields Financial Corporation, in cooperation with the loan brokers received "money for nothing" of $4,995 and $7,995 respectively. Neither borrower authorized the transactions, but the amounts showed up on the HUD-1s as a done deal. Both loans were processed by the same escrow company, but different brokers. Perhaps the DRE investigator can follow this lead. Fox Fields Financial's website shows the normal credit repair fee is $300. I'll look for any interest to show up in this thread of answers, and provide additonal information if requested.

If Green credit solutions was served with a Desist and Refrain Order to work on loan mods as of 6/25/09 by the State DRE, then all the people who signed up after that date would have a good case against the company no? Regardless of being BK, they broke a rule. I signed up with them in late August of 09 this year and finished paying them off in two installments and the last payment to them was in late Sept. And the fee which i paid for their services was borrowed money which I still have to pay back!

Is there going to be a light at the end of the tunnel.....?

They seem to now be working under Erickson Law Group or gmelawgroup.com. If you look on the "contact us" is all the same address. I believe Mr Gary Erickson is the attorney to Green Credit Solutions. So I am sure is all connected.

Im sorry to everyone that was scammed by this company. Curt Melone and Cris run a very SHADY company. To the people that live close to their new office in Lake forest i would tell you to just go in there and try to get your money back. This company has laid off all but 5 people and are no longer even working on any of the modification files. I heard that they pretty much just threw them away. The reason companies like this dont ever work out is because they were just in it for themselves. They never cared about a single client and they were always trying to figure out how they can make more money off others. Don' worry because Karma is a biaaaatch!!! And they are getting theirs!!! I have never seen a company go up so fast in business and come down so hard. Everyone who has been scammed get together and make sure you file a class action law suit!! Everyone just keep calling them and leaving lots of messages.

I'm in the same situation with Green credit solution/Get my credit grade. I actually had a representative call me early last week and stated it will cost me more money to try and get my $3495 back. I signed up with GCS back in late August. I am now in the process of review with my bank after 3 months of the bank ( Interest only loan mod dept and not reg customer service) telling me that GCS has not sent them any of my info for review. So I had to fax over all my info myself last week since i'm in the middle of foreclosure. If anyone knows how I can get my money back or free help/advice on getting my loan modified, pls let me know.

I just wanted to give everyone a heads up that I will be out of town attending to a urgent business matter all next week. I tried to email everyone the contact for the DRE investigator, and encourage every to contact the person immediately. Unfortunately, I can't post the contact information for the DRE on this website.

Have you filed any complaints yet with the BBB or the Attorney General of California? Even though we look like we are out of luck getting our money back I would still file. I also filed with the Department of Real Estate. I'm hoping some attorney will step up and help all of us out at Krista's request.

I am also a victim to this Green credit solution.

Not only they took 3495.00 for a loan modification ,but they also enrolled me in a debt settlement program with Erickson Law group which I just now realized they are all connected.

I don't know how I will get my money back for my loan modification, since it was all done through my agent. But she said she will take care of it. We'll see about that.

But for my debt settlement program it is automatic monthly payment from my checking. I will put a stop payment today and report them with the bank as a fraud so that at least the bank will open an investigation and hopefully I can get those 2 first payments they took for enrollmet for the debt settlement program.

Very dissapointed. I can't believe I became a victim.

Krista, your investigations will hopefully shed some light on the many parts of the web that has been cast by Fox and Melone and has trapped so many people. The past employee said that Guardian is still alive and well with Fox at the helm. However, he is not answering calls or emails. What is the process for class action or civil suit? Is this even a solution for those out of state?
Geo, if there is help out there do not give up yet. At the very least we should continue with the complaints against all the various companies that Fox and Melone are hiding behind and different names that they have themselves.
I personally am willing to take the beating and chalk it up to litstening to the wrong person and paying up front fees, but it is not fair to leave the battleground with our tails between our legs.

Found four small claims cases against Green Credit Holding and Green Credit Solutions in San Diego County.

One thing I did note on San Diego public records is that Gary Erickson (of Green Credit Capital and attorney for GCS) does have a civil history. Aside from the Accredited lawsuits there is a recent lawsuit in San Diego (3/09) for Professional Negligence, and two other suits pertaining to Accredited.

Now Green Credit websites require a user name and password, and the cache of their old website is gone.

I'm just sayin'

Thus far, I've only found an unlawful detainer in filed in June 2009 against GCS in Orange County. Perhaps GCS filed out of county or under a different name. But the unlawful detainer coincided with the move.

I'm not an attorney, and this is only my opinion, but this sounds like it would fall under the California Unfair Business Practices Act. The CA Attorney General should have already filed suit. I'm not an injured party, and it is my understanding that Whistleblowers cannot file suit under the Act. But again, not an attorney, and would greatly appreciate if attorneys would chime in.

It is my understanding that funds collected by borrowers were supposed to have been held in trust, and those funds were not supposed to be accessible to the company until services were performed. Because of the civil and tort liability (and possible criminal liability), I do not believe that bankruptcy would discharge the liability. However, it does require protection to ensure rights.

I'm compiling a list of homeowners and have drafted a letter requesting both refunds and trust accounting for several borrowers who have been ripped off. However, I really need an attorney to donate some time and step up to be involved. As a Real Estate licensee, I have to be careful that I don't step beyond the realm of broker to the unlawful practice of law. All of the borrowers I spoke to need attorneys. This is class action material. Again, not an attorney, but it would seem that if the contracts were in themselves illegal, and there was fraud in the inducement, the contracts should be void. But since I'm not an attorney, I can't make that assessment.

If you look at the CA Secretary of State filings, you see that GCS (and affiliated companies) changed their business address to the new company address. They changed their licenses. Guardian involves Christopher Fox. They are still doing modifications under Guardian and have not closed down.

It would be criminal in my mind and offensive beyond my senses for GCS to fund their new company by bankrupting the DEPOSITS (which is what they truly were) of their old company.

There is also the issue of investors in Green Credit Capital, and if they are included in the bankruptcy. I'll be watching this very closely.

Again, need a legal professional ASAP!!!!

I spoke with Christopher Fox the CEO of Green Credit Solutions (GCS). He indicated to me today that Green Credit Solutions has filed bankruptcy as of October 16, 2009. I requested a total refund of $3400 for services not rendered. Chris indicated that there was no money and I will not receive a refund! He also indicated that they have laid off 90% of their employees. He said that GCS will send me my financial package so I could continue with the negations with my mortgage company on my own!!!

This is the conclusion of my blog on this site now that we (clients of GCS) will not achieve our objective which is a loan modification of our sub prime mortgages. If there are any attorneys that can offer guidance without fees paid up front, your assistance would be appreciated.

In conclusion, Caveat emptor "Let the buyer beware".

I've done all those things and at this point I think it is left to a Class Action Lawsuit. My problem is I'm not in California, I'm in Oregon.

I am a little late obviously but I had pre-paid Green Credit in Feb. this year and have gone through the pain of no results in a promised 95% success rate for a loan modification. I have had limited access to Curt Melone and none with Chris Fox. I have seen two name changes and been through 3 customer representitives (2 of which have been fired). As stated the company no longer does loan modifications. Not only am I out the $3,450 but I am out the lost time of waiting for help from them. I am now close to the recast of my loan and will not be able to continue long with the payment if it does so.
I have filed a complain with the Calif. AG. Does anyone have any suggestions of where to go now. I have also officially requested a refund from them. I am not interested in letting this go...

There is clear documentation linking Green Credit Solutions to Guardian Credit Services. The corporate registration with the State of California shows Christopher Fox as the agent for service at the Foothill Ranch, CA address. Both website registrations for http://www.getmycreditgrade.com and http://www.myguardiancredit.com show Green Credit Solutions on the registration.

Green Res and GCS Marketing changed their license address with the California Department of Real Estate to the new Foothill address. Pacwest Funding also changed their address with the Department of Corporations for their CFL license.

The Secretary of State shows that CCS Marketing, Green Credit Solutions, Green Res, and Green Credit Financial all the same Foothill Ranch, CA mailing addresses and all companies are still listed as active.

Same companies, same players. Companies are alive and well and living in Foothill Ranch, CA.

Green credit solutions took our money and ran!!!! I don't think there is even a Green Credit solutions anymore.
They did absolutely nothing for us. Run as fast as you can!!!
