The seller is in New York, the title company in PA and the listing agent in a city a hundred miles away. The seller has drug their feet and caused many delays getting the FHA certification, the POA, and the deed. We finally have all the paperwork needed after 3 and a half months, when we found out that the title company is not liscensed in our state and will be mid-Feb before they are. Even better, the seller said they weren't going to extend the contract longer than 90 days, which means we have to close by 1/22. Our realtor is checking with an attorney, but I need to know if they can really do this? Seller cause the delays in closing, not us, but they are cancelling the transaction because of the length of time it has taken? If we do lose the house, do I have legal recourse? We have spent hundreds of dollars on repairs in order to get our appraisal and of course expect return of our earnest money. HELP!
What a mess!!!!!!!!!!! Sorry you have to go through this. Consult a REAL ESTATE attorney.
