Claire Morris…, Home Buyer in Martinez, CA

How does a tenant find out about the outcome of an auction on a house they occupy and how is the tenant protected?

Asked by Claire Morris Dobie, Martinez, CA Tue Jan 1, 2013

We know the house we rent is up for auction but we don't know what happens after it's auctioned. Can the people we rent from force us to pay rent to them AND the new owner?

Once the property is sold, your obligation is only to the NEW owner, not the previous one.

You should also receive a notice about who is the new owner

First, do you have a lease that is still in force? If so, the new owners should respect that lease.

If the new owners wants to occupy the property themselves, they should give you the proper notice and/or you can ask for them to buy out the rest of your lease. Perhaps you can come to a mutual agreement on what it will take for them to have you move. This is typical of "cash for keys"

Good luck.

Definitely DO NOT pay BOTH the new and old owners. As Loan suggested, pay whomever owns the house on the payment due date. The old owner may try to get you to pay early, so s/he can collect, but don't do it, because then the new owner can demand payment on the contractual payment due date and you would end up paying twice. Best of luck with your situation...

Once there's a successful buyer to the property, he will notify you. It is up to the new landlord to give you a 30 or 60 day notice to move out, honours with the existing lease terms or negotiate the new terms with you. As a tenant, you only pay the current landlord who holds the title to the property AT the time you pay your rent. Please note this is not a legal advise.
