How do we keep our house?

We contacted our mortgage holder to work out something to avoid going into default and were told that they couldn't help us until we did default. After we defaulted, the mortgage co. said they couldn't do anything because we were in default. They sold our loan and the new lender wouldn't return calls or answer the phone. They sent us letters stating we were in default & to come up with the money or else. We got a letter stating they could help us. We called & fed-x'd the docs overnight. They denied us and sold our home at auction. They stated they tried contacting us multiple times and we were uncooperative. We have proof no attempts were made on their end but were on our end. We filed a law suit for fraud. The investor that bought it wants to rent it to us or sell it at a profit. We cannot be financed because of the foreclosure. What alternatives are out there to keep our home?

I would see if you can find free legal assistance in your area and get an atorney to pursue this for you.

Hi Candace,

I wish I had better news for you, but it sounds like the foreclosure process is complete, and somebody else now owns your home. If you have filed a lawsuit, I imagine you are working with an attorney already? What advice has your attorney given you?

There is California legislation that deals with notification of homeowners prior to filing of the Notice of Default that went into effect in (SB 1137 http://sacramentorealestateblog.blogspot.com/2008/07/califor… ).

Dear Candace,

I am sorry to hear what you have been going thru and it must be hard for you and your family. I understand how you feel. You have done the right thing of consulting an attorney of the situation. You now should try to re-establish your credit and set a goal for purchasing another home for the future. You have done it once and believe yourself that you have the ability to create a new home again; sometimes, getting stuck in past of what, why & how it should not have happened might cost you more in the future.
