I would also recommend renters check online to determine their landlord's foreclosure status from month to month. If the foreclosure is detected early, they can approach the landlord to discuss the matter proactively, rather than waiting for the last minute when things might be very chaotic. Renters can check their landlord's foreclosure status FREE online in the USA at http://www.nyhousingcenter.com. FREE foreclosure info is available in the RENT section of the site.

Dear Patrick:

The tenant is required to pay rent regardless of a foreclosure status, after all, they are still living in the property. To find out if the house is in foreclosure, you can check web sites like http://www.PropertyShark.com, http://www.RealtyTrac.com or you may even be able to find out by simply "Googling" the address.

Jendrix5724 - you'll probably get more responses if you ask a new question. This question was 1st asked 2011.

Sounds like your friend needs to move...foreclosure or no foreclosure. $1,200 isn't much to save a house - sounds shady.

If you are the tenant you have a contract which is an agreement that you must abide by so, therefore you would need to continue paying rent. In AZ they recently changed the law so even if the home forecloses you can stay in the property as long as when the home sells at auction you are able to prove you have a lease and you are not related to the former landlord and the new buyer is not going to be an owner occupant. As far as finding out if the home is in foreclosure it's a matter of public record and you can check with the county recorders office to find the sale date.

As an agent you should know all these particulars recommend for you confer with your broker.

Home foreclosed - check county tax records.

Tenants continue to pay - governed by the terms of the lease

As for paying rent--yes, the landlord is still the owner until the lender takes possession, therefore do continue paying rent; have you asked your landlord if the property is in foreclosure, if not consider doing so; or ask any local agent, check public records for liens, etc.
