FIRST ANSWER
It's a foreclosure. I haven't seen it, but is it obvious? Maybe the agent didn't see it and of course there are likely no disclosures from previous owner. Pool is not listed on the tax role. Probably even if the agent knew there was a pool filled with dirt it's not something normally advertised. More likely it would appear on the disclosure.
