owners have put it on the market. What happens to us, the tenants? What legal rights do we have?
Hi Norma,
The first thing to do is to take a look at your lease agreement with a magnifying glass. Sometimes owners will put a 30 day notice clause in it in case they do decide to sell the home, but typically the lease agreement will remain in effect if the property is sold. This means that even if the property is sold nothing will change for you the renter, at least pertaining to the terms of your lease.
Secondly, here is a link to Arizona's Landlord and Tenant Act: http://www.azsos.gov/public_services/Publications/Residentia
This should answer any remaining questions you have that weren't addressed in your lease agreement.
And in Arizona, 48 hour notice is required for access to the property, not 24 hours.
A Tenant's attorney would be your best bet. He could take a look at your lease and tell you right away.
As a long time Realtor I can tell you that you have rights. If you have a 2 year lease, a new owner would have to respect your lease and could not evict you before your lease expires. Also, to show the property for sale they would have to give you at least 24 hours notice unless it was an emergency and I don'rt believe a sale is an emergency.
But of course, it depends on how the lease was written. Read your lease but also, show it to a Tenant's Attorney or at least a local Realtor to get an opinion.
You have whatever rights were written into your lease agreement. Your best bet is to bring your lease to a local real estate attorney and have them go over the situation with you. Generally you should be able to work it out with an attorney for well under $100 and you will have the peace of mind that comes with knowing for sure what your options are...When I've had issues that relate to things like this, I've found my real estate attorney to be absolutely invaluable.
I hope this was helpful!
