Can condo association stop the owners from renting out their condo, if there is a bylaw?

Yes, the bylaws are agreed to by all the unit members - it's a condition of ownership. Most condos on a square foot basis sell cheaper than homes, and one of the reasons is that you are giving up some freedoms to be in an association. Good luck!

Sorrel........just as an additional comment to my first one.............my condo association won't allow us to even have hanging plants outside our units (townhomes) !

When living in a association-controlled community - one must follow the rules.... and color in the lines! :)

It's best to know the community guidelines prior to making a commitment. These regulations are created and approved by the community residents and are intended protect the owner's interests.

Many people fail to read the Condo Decs, Regs & Bylaws during the purchase process, despite their Realtors advice to do so. So, new condo owners find out they have violation after they commit the violation. I suggest you contact a local attorney who handles residential real estate matters, including condo law.

Anyone contemplating buying a condo needs to read the bylaws before purchasing it.

Associatons can set whatever terms they want. Some have very strict rules.......some are quite lenient.

If the bylaws prohibit renting.........you can't rent.

Check with the association to verify this..........and, as Don suggested, if you still need further clarification.........ask an attorney.

Yes. Usually there is percentage of units allowed to rent out in complex. It vary from complex to complex.
