is my landlady required by law to pay interest on the last month rent deposit she has held for 20 years? I

live in San Anselmo, CA 94960

Hi Jane, The answer is a little complex, however generally depost interest guidelines are set by cities/towns not by state law. A quick search of the Municipal Code of San Anslemo revealed no guidelines for interest on rent or security deposits. A call to the planning department may be in order. We suspect that a simple discussion with the owner will suggest a compromise that would satisfy everyone. Best of Luck!

Hi Jane,

In MA, landlords are not required to pay interest on last months rent being held, as this money is not required to be put in an account. A security deposit, however, is required to be placed in an interest bearing escrow account, and the interest accumulated is required to be paid to the tenant.

FIRST ANSWER

It would depend upon the laws that applied at the time the lease/rental contract was written, and any changes to the laws since then. Changes in law may be retroactive, or may not be.
