in live in ny state and i have been told that i a refinance and my current lender does not do an assignment
of the loan, i will have to pay stamp tax on the refinance, which amounts to several thousands. Is this true? Aren't all lenders required to do an assignment of the loan?

FIRST ANSWER
who told you that? was is your current lender? if so they probably just want you to refi with them. i just did one with chase and we had a very tough time but we got it done and they were VERY resistance to the CEMA.
you save so much money that in my opinion you should force the issue.
