What if the escrow company over charged the closing cost and we could not close the escow and lost our EDM ?

Go after the escrow company, they shouldn't charge you so much money for escrow.

FIRST ANSWER
This is a very tricky question that one could not answer without knowing the details. I can say your agent if you have one should have reviewed the settlement statement prior to signing to ensure accuracy. You may very well lose you EMD depending on the contract terms. Sorry I caould not be more help.
