good afternoon......i suggest that you pull a copy of the last recorded deed(s) on public record..you can obtain that from either the register of deeds or have a title/escrow co.do it for you.....the deed(s) will tell you who is on title and how you hold title.....if you all hold title as joint tenants in common, then the deceased's interest would have to go through probate......if you all hold title as joint rights of survivorship, then the deceased's interest would automatically transfer to the remaining owners with no probate involvement.....if you need to change how you hold title......i suggest all of you go to a title/escrow company and you can quit claim deed to yourselves in the manner which you wish to hold title....lastly, some states require marital status on real estate documents..trust the escrow/title co. to guide you through the process....best regards..bob mcclure- success mortgage partners- plymouth, michigan.......
