we put in an offer on a short sale last monday with an earnest deposit. the seller accepted our offer on thursday. now it is up to the lender to accept the offer as well before anything proceeds forward.
when does the clock on the earnest money start? when the seller accepts, or when the lender accepts? im assuming its when the lender accepts because thats when a purchase contract will have officially started; but i dont want to assume cause well...you know why.
the purchase agreement states when the seller accepts. That is why it is imperative that a short sale addendum is included with a purchase offer on a short sale. ON that addendum there are two fields that need to be checked to have all timeframes started upon LENDER's acceptance instead. One talks about when the deposit will be surrendered to the title company, the second for when the timeframes for inspections is to start.

We put an offer on a short sale on April 18th with an earnest deposit. According to my realtor the clock starts ticking when the lender accepts (in writing). As an FYI we haven't heard anything on the short sale. As of 1 week and half ago we were told a negotiator was going to be assigned last Wednesday. As of today, no one has heard from the negotiator. We will probably pull out and get out deposit back. Good Luck ... I would recommend you keep looking at other homes. We are and have found a couple of homes but nothing set in stone yet.
