Crimes are classified as: felonies, misdemeanors and infractions. A felony is punishable by 1 year or more in prison, while a misdemeanor is punishable by under 1 year in county jail. An infraction, such as a traffic ticket, is normally punishable by a fine only.

However, someone can commit a felony and the court can decide to punish the defendant with a fine and community service only, etc. This would most likely happen when a defendant has no criminal history and/or he committed a non-violent crime.

Also, when you commit a crime against a person such as rape or robbery, the punishment is usually more harsh as opposed to stealing something from a liquor store or tagging on a bus bench.
