Can an HOA in Florida require the use of a non-transparent windshield sticker for opening an access gate if there is a swipe card option(open window)?

It seems most states have windshield sticker laws. Some states, including the one where my car is registered, don't allow non-transparent stickers. Some states allow only government issued stickers.

Help the community by answering this question:


Besides opening the gate, what other purpose does the windshield sticker serve?

Perhaps A-Jax towing is commissioned to hook any car in a reserved spot which does not present the proper windshield sticker.

The best solution to your problem is to call a Bradenton REALTOR and find a friendlier place to live. You won't win this battle and may become intimately familiar with the accounts receivable dept at A-Jax.

It unlikely that any HOA would knowingly require its residents to do anything illegal. If this is a serious issue it would seem that more people than you would be experiencing concerns. Consider attending an HOA meeting to bring up this issue. The opportunity to speak out on concerns such as this is part of the democratic process embraced by HOA's. Take advantage of it!

Florida Statute states as long as the sticker does not materially obstruct the driver's view it is permitted.

So the answer to your question is, if the sticker does not materially obstruct the driver's view the HOA can require the use of that sticker..
