Is there any way to speed up the process? I'm representing buyer on a short sale and I understand we have about 45 days before foreclosure auction.(First Tue in September). Buyer is Strong...Offer is good...seller has signed contract. Appraisal is today from CW, but they're saying they won't assign a negotiator until 30 days after one is requested....which I now understand will be 1st week in August. The delay could break the deal. So what I really need is for CW to assign negotiator faster........Is there anything that can be done?
Good luck with that. Like the others said, the seller's agent is the one in charge...as far as making contact with the bank. As the buyer's agent there is not really much you can do but keep in contact with the seller's agent to make sure they are keeping in contact with CW. I had an experience being the buyer's agent where the seller's agent told me that a negotiator at CW shredded our file because she got angry. These times are strange and are taking a toll on a lot of us. I am now dealing with waiting for Indy Mac to assign a negotiator. I will keep my fingers crossed for you (and me!).
My recent experience with CW is that after the appraisal goes into the system (if your appraiser is going out there today it may be in the system by Tuesday/Wednesday) it then takes 10-15 days to get a negotiator assigned. You do need to call and saty on them in case your offer is lowr than the appraisal . If this happens, no one will call you. You wil be placed into the triage department (like pergatory) and you'll have to find out on your own.
Once the negotiator is assigned it takes another 10 days or so (they order payoff and go to investors for approval etc.).
If you keep the Buyer's Agent in the loop every step of the way and give him the timeline laid out then there will be ni surprises. Buyers do go away because of the wait just ask the buyer's side to let you know if anything changes. That's all you can do.

I just closed four short sales with Countrywide. I do not believe it is possible to get a negotiator quickly. But I do believe Countrywide is likely to postpone the foreclosure as long as the short sale process has been started. It is in their interest to do the short sale. Beware of their appraisals and BPOs: they often come in very high. You may have to challenge them. They will order a new BPO if you make the request. Overall the process was fine; other than the fact that it took about three months to get a "yes" from Countrywide. Due to the long process, we lost a couple of buyers. Plus the market declined and Countrywide had to take less than they would have gotten if they had assigned a negotiator right away. Good luck! Charlotte Laws

This is tough because you represent the Buyer, not the Seller. The Seller & the Seller's Agent really have their homework cut out for them if they want to avoid a foreclosure. Have they submitted a completed short-sale/hardship package to Countrywide yet? Have they considered hiring a short-sale facilitator to assist with the process? What reason are you being given for the 30 day delay?
