If I have a complaint against an agent but fear retaliation from this 'bully' agent, how useful is it to complain to the board or DRE?

Asked by Fred Macias, Huntington Beach, CA Thu Apr 14, 2011

If anyone has experienced a physical assault, as I have, and is willing to shed light on the topic with me - - I would greatly appreciate it. I don't want to write details but I wish to discuss it to determine a course of action. I am a person of principle but I am concerned that the board and/or DRE will do nothing. A few investigative questions I have are:
- Is it possible to see if another agent has prior complaints filed at a board or DRE?
- I am looking for other agents to share their experience with me so please call me at 714.342.9995.

The fact that you were touched without your permission should be reported to the police, your broker and the DRE.

Good luck to you.

Hello Fred,
Wow! An agent who uses physical violence on another agent should not be practicing real estate in my estimation. Yes, I definitely suggest that you speak with your Broker about it and file a formal complaint with your local REALTOR board as this agent needs to learn that this type of behavior is totally unacceptable. The Board takes these type of issues seriously and will determine how this agent should be reprimanded.
I once filed a complaint with my local board about another agent's conduct and won my case as she had violated one of the standards of practice with NAR's REALTORS Code of Ethics.
Good luck to you!

Dear Fred,
My gooness! I would contact the DRE and post a ethics complaint about this agent. Furthermore, I would make your broker aware of the situation as well. I have seen some pathetic behavior by unscrupulous individuals, but it has never been physical.
Im sorry to hear this and I do hope you take it all the way to the removal of this persons license to practice Real Estate.
