I agree with Michael Cheng. At best, you may get a refund of the inspection fee.
It seems as if there are two issues here. One is that the fill pipe is corroded, and the other is the location of the tank. Since you had a discussion about the tank, the inspector didn't "miss" this, they just have a different opinion of what is "safe" than the oil company does.
The easy solution is to instal a new septic system. HOWEVER HURRY! The new septic code goes into effect on 1 January 2013. You must apply for a septic permit before 10 December 2012 to be under the old, much less stringent and much less costly code. In this case a small investment now will save many thousands.... more
It's important to be working with a great lender who will prepare the proper documentation and give you the loan product guidelines on gifts (from parents). The title company and lender along with your realtor can coordinate every step of the transaction.
There can be limits on the amount of money any one can give towards a downpayment so be closely in touch with all of the above early in the process.
