Being offered the property you want and lost to a higher bidder is a good sign. You've been invited back to the table. Since your concern is with the listing agent and (thankfully) not your own, express your concerns to him or her and ask how they can ensure your offer is (actually) presented. The issue and responsibility of presentation belongs to your agent - not you as the Buyer. And your agent "should" be able to present your offer directly to the Seller unless the Seller objects to such an arrangement. Additionally, if your agent suspects something is going array, they can enlist the assistance of their Broker who can contact the listing agent's Broker.

You can certainly put a time limit on your offer and ask your agent to be present when the offer is submitted, so that you can be sure it was submitted as offered. You may ask that your address be withheld from the purchase offer, or use your PO Box.

It might be considered low to a seller, however a buyers agent can present such an offer as a starting point in which then you would hopefully get a counter offer back from the seller. Which in that case, then don't be surprised if you do not get a counter offer back because a seller may get insulted. It it though still a buyers market so then, it would be smart for the seller to counter back. However, not all sellers are smart but are instead emotional about there home. Also, the seller
may owe the bank X amount and cannot afford to sell for less.... more
