There are a few factors to consider. Did the Realtor know of an existing issue and fail to disclose it? Was the existing issue known by the seller prior to the inspection?

As a buyer, you have an option period in Texas to have the home inspected. Although you may have received a seller's disclosure on the property, a home inspection is the best route to discover issues with the home.

Depending on what was disclosed during the inspection, did you ask the seller to remedy the issue through a repair amendment?
