The public records show the square footage of the property as 2876 sq ft. The agent has the property listed at 3440 sq ft as you have mentioned. It seems like they may have had an appraisal report and it was measured as 3440, which does not mean that the information is correct or they may have measured it themselves. The buyer will get an appraisal report and that report may show a different number also.
The seller of any property needs to disclose where the square footage information came from. It can be from the public records, measured, appraisal, other, builder.
Are you planning on selling your property also and are thinking that the neighbors property is more square footage that yours when it is the same? I am sure the buyer will find out and then there could be issues where the buyer may ask for a price adjustment. I had the same problem when I bought my house. The seller listed it as 400 sq ft more than it actually was since he based it on the appraisal report. We had 3 different reports with different sq footage on each. Unfortunately at the time the prices were going up every month and the sellers did not give me a price adjustment. Since I wanted the property, I went ahead with it. There was very little inventory then on the market.
