The buyer has a right to have the property surveyed before purchasing it and it is recommended that it be done to assure that there are no encroachments, etc. The buyer typically pays for the survey since it is for the buyer's benefit. Occasionally some municipalities require a new survey for C.O. transfer purposes. It should be addressed in the contract who will be paying for the survey if the seller is required to get one in order to obtain the Certificate of Occupancy. - Wed Sep 22, 2010
