In many situations, buyers will have the opportunity to review Seller Disclosure's and be able to make an intelligent offer off of that. Also, and usually at point of sale, a buyer can see the problem and request that the agent inquire about it. If the answer is satisfactory then again the buyer has the knowledge of the problem and hopefully the remedy for it. The days of buyer beware has been superceded by the knowledge of their Realtor, the expertise of their home inspectors, the compliance of municipalities that require CO's and the legalities through the use of attornies.
Therefore, the only beware of the buyer is to beware not using the right professionals to assist them. And for those that refuse to use a professional, the old adage penny wise, dollar foolish definitely applies.
