Why not contact the IRS directly and ask that question? The list of local phone numbers in Virginia is below:

While the IRS is not in the habit to give away money, at the same time, I think they will try to be fair to you - the tax credit was meant to stimulate the housing market - you should qualify for at least the $6,500 tax credit, or half of each credit ($3,250 + $4,000 = $7,250).
