Q:A:Sorry to hear of the difficulties you are having with the former owners. If the property was sold, then the previous owners (the ones who lost home to foreclosure) do not have rights to the house, they do not have the right to throw out your stuff, or start eviction procedings. You are smart to contact police, current owners, and an attorney. Sounds like you may need to file a restraining order too? Make sure to document everything! Good luck!
Q:A:Earnest monet is due when the offer to purchase and contract says it is- generally at acceptance of contract or within 5 days. Due diligence money is not allowed for a short sale, as selers cannot benefit from the sale. Q:A:Wendell doesn't have anything going on after 10. However, if you are looking for a place for dinner and a glass of wine or a bottle of beer, I would like to make a recommendation. My husband and his parents have a restaurant in Wendell called Boulevard Pizza. It's across from the McDonalds. They have pizza, subs, pasta, burgers, etc. Check them out online at www.blvdpizzawendell.com. They close at 10 on Wed-Sat, close at 9 on Mon and Tues, and closed all day on Sunday. Q:A:If you and your wife are both on the mortgage, and you want to take her name off, then you will need to refinance, then quit claim deed after the divorce. The deed and the mortgage are 2 separate things to address. Of course with refinancing, you would need to be able to qualify for the morgage completely on your own, taking into consideration your current debt obligations. As for purchasing a car next year, you would want to consider what your debt obligations would be at that time, including any alimony or child support, should it come to that, and if the lender requires that disclosure in repaying a debt. Your wife's ability to get an apartment will generally be determined by her ability to repay and have no late payments on her debts. If refinancing is not an option, you could sell the house and purchase another one (or 2). I commend you for being proactive and looking at all of the options when you and your family are going through such a difficult time. In the event you decide to sell, give me a call.
