An agent, nor a broker can terminate a contract once it has been signed by both buyer and seller. If both buyer and seller agree to not enforce the contract, it can work out well.....or it could be the foundation for a problem......since only an attorney can cancel a contract once it has been signed by both parties. There are some technicalities that could be called into question, such as was a copy of the signed contract delivered to you or your attorney on your behalf? If a contract bears the signatures of both a buyer and seller, it is best that you have an attorney terminate the contract.
Is this the only reason that you want to x the contract? What about your interest in the property? I would certainly recommend that you not walk away from a property solely because an agent annoys you.
Whether you want the property or not, I suggest that you contact the broker. You will be doing a service for the general public and the broker. The broker will want to know about this and take corrective action in an effort to service both you and all clients. The broker is responsible for this transaction and can assist you by either helping you get the contract terminated through an attorney, or by supervising or assigning another agent who will assist you in completing the purchase. Either way, the broker can help you.
