I think this depends on your state - you need to ask a real estate attorney or the probate attorney. I would think the answer is no... but seek legal advice.

I wonder if Andy is asking as buyer's agent. If we ask for a pre-approval before we show houses, what would a cash buyer have to show before looking at houses. To answer that question, I would say that they have to show POF the same time anyone else would have to show a pre-qual.... if they aren't comfortable sharing that information with me directly, I would have them speak with my mortgage rep as any other buyer would...

helpme! you need an attorney - it's very difficult to negotiate with the banks - it's also hard to get them to waive the deficiency; especially if you don't have someone experienced in your corner. Are you working with a realtor? Maybe he or she can help. Otherwise, please find an attorney, I am sure they aren't all scammers....
