Question 1 - When settlement doesn't take place, the title search & survey will be billed to you by the attorney because the attorney gets billed because he ordered it so he in turn passes it on to you. The title search and survey you are responsible to pay because the services were provided on your behalf. You are also responsible for the appraisal and home inspection but they are usually charged to you at the time of service.
Question 2 - When selecting an attorney, make sure you pick an attorney that only does real estate full time not a criminal attorney that does real estate part time. You will usually get a recommendation from your agent or your lender. You should interview each person to see if they will be good for you to work with. Even if lender refers him he will still go over the mortgage and said is this what they told you were the terms, if not then he will say don't sign it.
