You're confusing two issues: Ethics and your personal financial condition. In the purest form, all of your actions and decisions will be based on whatever ethical code you subscribe to, however nobody actually acts in that manner. We all justify or rationalize our decisions to suit or own desires or meet our own goals whether financial, moral, or whatever.
Should you short sale your house? If you are looking out for only your families financial condition, then the answer is almost certainly, Yes. However, trying to villify a bank with the rationale that they are getting unjustly enriched at your expense is a bad argument. The 'slippery slope' of possible actions that an unjust enrichment argument could lead to is staggering in scope.
If you are going to do it, then just do it and don't worry about what other think of you. The only rationale that you really have to live with is the one you make to yourself when you look into the mirror every morning. - Thu Dec 10 2009, 12:58
