I wrote a blog post answering this question (see web reference). If a home has not been occupied by the seller in the last three years they are not required to fill out a property disclosure. If you are referring to a vacation home that is being rented, you can certainly request to see rental records but I'm not aware of any legal requirement to disclose these (I'm not in a daily/weekly rental area so I'm not the expert on that type of thing). - Sun Dec 13 2009, 16:15
