Average sold price for homes at Shady Canyon Irvine so far this year has been $4,245,000.

Starting with 2012 tax bill (the one due in April 2013), the CA state Franchise Tax Board (re income tax) will require property owners to break down their property taxes into deductible and non-deductible portions.

So property owners who have been deducting their Mello-Roos fees and school bond fees paid (which are sometimes very large in amount) will no longer be able to deduct those or any other special assessments, such as vector control or mosquito abatement.

This change in policy by California Franchise Tax Board is important for some California property owners.  Many home developments at South Orange County had public amenities paid through Mello-Roos bond districts.

Home and property owners will not be able to use these special assessment payments as CA state income tax deductions starting for this tax year 2012 – for California income tax filings starting January 1, 2013.

California property buyers and owners should consult with an experienced income tax professional or attorney about their own situation – possible CA income tax deductibility for buying and owning real estate in California.

Buyers at Irvine now have more competition - it’s harder for buyers in this market.

As of March 15, 2012, Irvine had 538 homes listed for sale on the MLS multiple listing service system.

Irvine then had 261 new deals opened in the past 30 days.  According to Thomas, Irvine had ”market time” – months it would take to sell all inventory at that pace of new escrows – of 2.06 months vs. 3.44 months seen one year earlier.

121 of the Irvine CA homes listed were either foreclosures being resold or short sales, where sellers owe more than the home’s value – so distressed properties were 22.5% of supply of homes for sale.

Irvine homes for sale made up about 7.7 percent of all Orange County CA number of homes for sale.

373 Irvine homes have resold so far this year 2012 – with average sold price of $639,157 – average market time of 104 days.

California government has favored consumers for years and has a number of laws on seller disclosures to protect home buyers.

New CA law - CA Senate Bill 837 – says that home sellers must disclose to buyers whether there are water-conserving plumbing fixtures.

The TRANSFER DISCLOSURE STATEMENT (form provided by California Association of REALTORs) has been revised to include checkbox in Section IIA for a seller to disclose whether the property has water-conserving plumbing fixtures (low-flow toilets, shower heads, and faucets).

This revised transfer disclosure statement (TDS) also clarifies in Section IIB that, by January 1, 2017, a single family residence built on or before January 1, 1994 must generally be equipped with water-conserving plumbing fixtures.

In other words – starting as of January 1, 2017 – any California home built before January 1, 1994, will require water-conserving plumbing fixtures as a point of sale mandate.

If, however, the single-family residence is altered or improved on or after January 1, 2014, the water-conserving plumbing fixtures must be a condition of final permit approval.

CA Senate Bill 837 was chaptered as state law and codified as Cal. Civil Code § 1102.6 – became effective on January 1, 2012.

Senate Bill 563 – new CA law for 2012 - new requirements regarding the actions of homeowner association boards between meetings.

• Homeowner associations must notify members at least two days prior to a meeting of the board's executive session.
• Allows for meeting notifications to be sent electronically to homeowners and permits board meetings to be conducted by teleconference as long as they are conducted in a manner that protects the rights of members.
• Notices of teleconference meetings must identify a physical location so members can attend and requires that at least one member of the board be present at the location.
• Board of homeowner associations are prohibited from conducting a meeting via a series of electronic transmissions, such as email, except to conduct an emergency meeting.

Investors look at Capitalization rate (or “CAP rate”) of a property to help determine value.

CAP rate is ratio between the net operating income (NOI) produced by an asset and its capital cost (the original price paid to buy the asset) or alternatively its current market value. 

CAP rate  =  Annual Net Operating Income (NOI) of an asset (property) divided by COST (or current value of the asset)

The higher the NOI is in relationship to cost (or value) of the property, the higher the CAP rate would be.  When investors see higher CAP rates, they value proposition better.

CASH FLOW -  money the investor will have after collecting monthly income from property and paying all expenses (including property taxes, insurance, maintenance, mortgage, etc).  But CASH FLOW is different for each potential buyer and impacted by expenses, like property taxes, insurance, maintenance, and debt service payments.  Loan or debt service payments will directly relate to interest rates, amortization period, and down payment.  Different buyers will use different kinds of financing, and one is likely to have higher debt payments than the other and different CASH FLOW.  So CAP rates help investors more in determining value.

CAP RATES are a better measure of a property’s investment potential, regardless of what specific buyer and debt payments.  CAP RATE should be the same regardless of who is buying, and different investors can do an apples-to-apples comparison of the same property, is equal to return on investment (ROI) the investor receives if he pays all cash for a property, and is a good tool to help determine value.   

Investors always want to see properties with higher CAP rates to determine positive value.  It makes sense that some look at proposed CAP rates here at Orange County, CA…  of about 5 percent … and want to get improved value with lower prices.

The average rate on a 15-year fixed mortgage conforming loan has fallen to 3.25 percent (loan up to $417k with one point paid by borrower – as of September 2, 2011)

Irvine CA home buyers snagged and closed escrow on 184 homes last month during August 2011, with average sold price of $631,710.

(So buyers paid $11,623,464 for Irvine resale homes during the month of August at Irvine CA real estate).

92 of those Irvine CA resold homes were detached (fifty percent of solds), and others were attached homes and condos.

August 2011 Irvine home resales were only 5 percent down from last year August 2010 when Irvine sold 175 homes, with average sold price of $661,418.

Irvine CA homes resold in price ranges during August 2011:

• 72 sold at price up to $499,999 (39 percent of market)
• 93 sold at price between $500k and $1 million (50.5 percent of market)
• 16 sold at price between $1 million and $2 million

800 Irvine CA real estate homes were listed for resale at the end of August 2011, with average asking price of $867,655.  170 Irvine homes were listed for sale as short sales at that time (21 percent of listings).

A friend asked yesterday whether he could buy a house in Orange County first and later sell his prior house in Orange County while taking advantage of California Proposition 60 on transfer of property tax basis.

Answer is “YES” if you follow all conditions for qualification and tax relief as set forth by the Office of Orange County Assessor.

California Proposition 60 allows transfer of an existing Proposition 13 base year value from former residence to replacement residence, if certain procedures are met (once in a lifetime benefit for homeowners who are 55 years of age or more).  

Proposition 60 was a constitutional amendment approved by the voters of California in 1986.  This is codified in Section 69.5 of the CA Revenue & Taxation Code, and allows the transfer of an existing Proposition 13 base year value from a former residence to a replacement residence, if certain conditions are met.  This benefit is open to homeowners who are at least 55 years old and are able to meet all qualifying conditions.

The following conditions must all be met for qualification and property tax relief to be granted under California Prop. 60:

a)  Both the original property (former residence) and its replacement must be located in the same county. If the replacement property is located in a different county from the original, see CA Proposition 90.

b)  As of the date of transfer of the original property, the seller or a spouse living with the seller must be at least 55 years old.

c)  The original property must have been eligible for the Homeowners’ Exemption or entitled to the Disabled Veterans’ Exemption.

d)  The replacement dwelling must be of equal or lesser value than the original property (There are exceptions when you buy a replacement home within one or two years after sale of prior residence).

e)  The replacement dwelling must have been purchased or newly constructed on or after 11/06/86.

f)  Without exception, the replacement dwelling must be purchased or newly constructed within two years (before or after) of the sale of the original property.

g)  The original property must be subject to reappraisal at its current fair market value as the result of its transfer, in accordance with Sections 110.1 or 5803 of the Revenue and Taxation Code.

h)  Without exception, a claim for relief must be filed within three years of the date a replacement dwelling is purchased or new construction of a replacement dwelling is completed.

Even though Irvine CA is the economy driver at Orange County CA and has lots of jobs at private and public sector employers, foreclosures continue to be an important part of the real estate landscape.

Irvine was like other cities in California during June 2011 and had slower property foreclosure activity ~ notice of property default filings were down 24.6% from May 2011 and down 19.7% vs. June 2010.

Irvine’s notice of trustee auction sale filings were down 19.6% as compared to May this year and down 33.8% as compared with June 2010.

Irvine’s foreclosure outcomes during June 2011 were interesting with Back to Bank REOs 31.8 percent higher than last year during June 2010.

Irvine’s foreclosure outcomes had 15.3% fewer properties sold to third parties at trustee auction sales as compared with June 2010.

The Irvine CAforeclosure filing numbers down is probably related to lender’s slowing of their processes so they can confirm what entities have legal right to start and complete the non-judicial foreclosures.

The ORANGE COUNTY GREAT PARK at Irvine CA kicked off its anniversary celebration on Saturday, July 9.

U.S. military aerial demonstrations and fly over, police aircraft, vintage airplanes, helicopters, and aerial show were dramatic and got lots of attention.

Current centerpieces for the ORANGE COUNTY GREAT PARK are the vintage carousel and the huge helium balloon ride. 

Parking for this ORANGE COUNTY GREAT PARK anniversary party at Irvine CA was well-organized, and admission is free. 

It looked to me like they had more than 20,000 people attend this event and involved with activities on July 9th.

City of Irvine council and Great Park board leaders hope this ORANGE COUNTY GREAT PARK at Irvine CA will be AS large and as well-liked as Central Park in New York and Golden Gate Park in San Francisco.

Palm Court Arts Complex will debut soon week with art gallery and artists’ studios and plaza lined with palm trees.

The North Lawn will be 19.5 acres of green open space and soccer fields.

The art court and lawn are first ORANGE COUNTY GREAT PARK areas to open under the Western Sector Park Development Plan, to eventually expand the 1,347-acre park’s recreational area from current show park to more than 200 acres.

We saw and visited with friends at this ORANGE COUNTY GREAT PARK at Irvine event, including Irvine city council member Jeff Lalloway and his family.

For this summer 2011, THE ORANGE COUNTY GREAT PARK at Irvine CA will have Saturday night concerts, the helium balloon ride, bike rides and demonstrations, entertainment for kids, food trucks, Sunday morning farmer’s market, and Friday night dance parties.

819 Irvine homes sold during first 5 months of this year ending May 31, 2011, which is average of 164 homes sold per month.

Average Irvine sold price during this first 5 months of this year was $643,756 (which is 24% lower than average asking price).

Irvine sold 186 homes during May 2011, and average sold price was $688,394.

Irvine sold 220 homes last year during May 2010. That was during time of government homebuyer tax credit incentives, which are now gone. It’s not surprising that number of Irvine homes sold this year during May was down from that of last year.

At current rate of Irvine home resales, it would take 4.5 months to sell all homes now listed on the market. That’s balanced and doesn’t favor buyers or sellers.
