Florida "SAVE OUR HOMES" is Saved Again....

As reported yesterday the News Service of florida, Florida's "Save Our Homes" was saved once again when a case filed by out of state property owners was rejected by the First District Court of Appeal...........

TALLAHASSEE, Fla. – Sept. 14, 2010 – The First District Court of Appeal on Monday again rejected an appeal by out-of-state homeowners questioning the constitutionality of Florida’s Save Our Homes amendment and its offspring, the amendment that allows homeowners to take SOH tax savings when they move to a new home.

The latest case was filed by a group of property owners led by William Deluccia who owns property in Florida. The Court of Appeal previously rejected an appeal filed by a group of out-of-state property owners whose challenge had been dismissed by Leon County Circuit Court Judge Jackie Lee Fulford. In rejecting the lawsuit, Fulford said multiple cases had already upheld both the original Save our Homes amendment and a 2008 amendment approved by voters that extends a portion of the tax cap saving to homeowners who relocate within the state, called the portability amendment or Amendment 1.

“As the trial court rightly determined, we have previously rejected these arguments,” the appellate court ruled in a four-page group opinion, three pages of which were devoted to the parties and attorneys involved the case.
