Wrongful Foreclosure Dont Let This Happen to You! US Bank v Ibanez incorrerctly identified wrong mortgage holder notices
Wrongful Foreclosure Action Ibanez v US Bank Early 2011
This is already in the supplamental law books.
It is extremely important to keep all of your documents if your going thru a foreclsoure. The lenders and servicers may not always do things correctly.
Here in the United States we have what is called Due Process.
In Ibanez V US Bank the lender / Servicer made such a critical mistake the home owner actually got their home back after the wrongful foreclosure action.
There have been other wrongful foreclosures that have been "cured" MPP Investment Inc v Cherokee Bank in Jan 2011 where the foreclosure sale was invalidated because (where mortgagee failed to serve 60-day notice required by security deed).
We have due process, Which can be a very good thing
