    Bank of America reviewed 102,000 foreclosures in the 23 states where a court must sign off on the proceedings, and it is now restarting the process on those cases, the company said yesterday.  The company said the first of the new affidavits will be submitted by Oct. 25, and that it will continue its review in 27 other states.  According to a spokeswoman for the bank, no errors were found during the review, and fewer than 30,000 foreclosure sales across all 50 states will be delayed as a result of the investigation.  The announcement comes one day before the bank's third quarter earnings report, and might ease investor concerns over the scale and timeframe of the bank's review process.  "This is an even better outcome than we previously thought," said Paul Miller, an analyst at FBR Capital Markets. "We thought January was a more likely time to restart the [foreclosure] process."  All told, 1.8 million loans are in foreclosure in the 23 so-called judicial states, while 1.3 million are pending elsewhere in the country, according to a Morgan Stanley analyst report.

    Like I said, this is huge news....Despite record low mortgage rates, the entire housing market is still waiting for new demand to replace the boost from the homebuyer tax credit that expired in April. 
    While transactions are down, prices are still up for the 11th month in a row, following more than two years of straight declines.  The median price on a California home was $265,000, a 5.6% increase from last year and a 1.9% bump from the previous month. The trough came in April 2009 at $221,000. The peak was $484,000 in early 2007.  Of the existing home sales completed in September, 35.8% were properties that had been foreclosed on in the last year, down from 41.7% a year ago and flat from the previous month. Foreclosure accounted for more than 58% of the market in February 2009, the all-time high.  Homeowners made an average $1,055 monthly payment in September, down more than 60% from the peak in June 2006

    FBI looking at foreclosure mess, as much as the big banks want to end the mess and move on; as much as the country NEEDS this mess to be over, it looks like it's around for a while.  Attorneys general in all 50 states are jointly investigating whether lenders violated state laws, lawyers for evicted homeowners are preparing lawsuits against major lenders, state judges have signaled they will review the banks' foreclosure documents with skepticism, and lawmakers on Capitol Hill plan to hold hearings.  On top of all that, now and unnamed official has told CNBC that the FBI is in the initial stages of trying to determine whether the financial industry may have broken criminal laws in the mortgage foreclosure crisis.  The law enforcement official says the question is whether some in the industry were acting with criminal intent or were simply overwhelmed by events in the wake of the housing market's collapse.

    The official spoke on condition of anonymity because the investigation is just getting under way.  Hundreds of judges around the country have the authority to penalize bank officials who violate their procedural rules.  They could also force thousands of foreclosure cases to go to full trials rather than issue a quick ruling.  "There could be some serious consequences," including criminal charges, Zoeller said.  Even if there aren't, lawsuits are likely to continue for years, said Guy Cecala, publisher of trade publication Inside Mortgage Finance.  "Some of these plaintiffs' attorneys clearly smell blood in the water," Cecala said.

    The most successful Realtors, Mortgage People, Short Sale, Loan Modification Experts 
    are those who have networked and have established relationships/are well thought of by other realtors and also have a presence in the community. In my area, there are a few realtors that consitently have a high # of homes sold (they're published in our local paper) and they also happen to sponsor charity events/give back to the community. There are other, cheaper realtors, but when I sell I'm going with the ones that I see out there working and giving back. Incidentally, they're all with different companies, but they seem to work well together.

    I think they can shorten the gap between  a seller and potential qualified buyers and that's definitely worth it.

    Another question that I'd ask is who exactly is going to be handling your house?

     One of my neighbors went with a real estate agent who's new and inexperienced assistant ended up handling her house. It was a disaster.

    And I'd ask how they're planning to market my house. Especially in this market, they've got to have a plan that involves more than a sign in the yard and an mls number. For example, lately the houses in my neighborhood that are for sale have their own websites. Blogs, Webites such as in 234MainStreet.com Hamilton Mill Dacula GA. My hat's off to the agent(s) who thought of that. I thought it was a great idea and the websites are very well done.

    So when you are looking to Sell your home in this Market...Look...Ask...Ask

    Go online and do your research...what do they do online...Website...Blogs...Email..etc

    f) If you have the money remaining, pay the house payment next. If your mortgage is too high, you can either attempt to get a payment reduction from your lender. If that doesn't work, and you have no other options, then you can sell the house thru a "short sale."

    g)    Only after you are taking care of yourself and your family should you pay any money to unsecured debts such as credit cards and student loans.

    Foreclosure auctions hit new record...Hamilton Mill Dacula Ga Short Sale Update

    RealtyTrac says 372,445 foreclosure auctions were scheduled in July, August and September, while 288,345 properties were repossessed by lenders over the same time period.  Overall foreclosure filings edged up to 930,437 in the third quarter, a 4% increase from the previous quarter. One in every 139 homeowners received a foreclosure filing during those three months.  Bank repossessions, or REOs, also are on the rise. In September, a record 102,134 homes were taken back by banks. It's the first time repos have topped 100,000 in a single month.  The uptick is not expected to last, RealtyTrac CEO James Saccacio said in a statement, because several major loan servicers have halted foreclosure sales pending a review of documents.  Nevada had the nation's highest foreclosure rate, up 1% from earlier, for the 15th quarter in a row.

    One in every 29 Nevada homes received a foreclosure filing during the third quarter.  Looking at total numbers of foreclosures, neighboring California was worst, with 191,016, followed by Florida, Arizona, Illinois and Michigan. Combined, the five states accounted for half of all foreclosures last quarter.  Of course, once the moratorium ends, we can expect a new tidal wave of foreclosures. John McGeough, a broker, said that the current foreclosure freeze may give distressed homeowners extra time to do a short sale and avoid having their homes repossessed by the banks. "Foreclosure should be the last resort."

    just how bad is the mortgage mess? can you spell...B...A...D

    "There has been plenty of pontificating over the ramifications of foreclosure freezes on troubled borrowers, foreclosure buyers and the larger housing market, not to mention lawsuits, investor losses and bank write downs. There has been precious little talk of what the real legal issues are behind the robosigning scandal. Yes, you can't/shouldn't sign documents you never read, but that's just the tip of the iceberg. The real issue is ownership of these loans and who has the right to foreclose. By the way, despite various comments from the Obama administration, foreclosures are governed by state law. There is no real federal jurisdiction.  A source of mine pointed me to a recent conference call Citigroup had with investors/clients.  It featured Adam Levitin, a Georgetown University Law professor who specializes in, among many other financial regulatory issues, mortgage finance. Levitin says the documentation problems involved in the mortgage mess have the potential 'to cloud t
     itle on not just foreclosed mortgages but on performing mortgages.'  The issues are securitization, modernization and a whole lot of cut corners. Real estate law requires real paper transfer of documents and titles, and a lot of the system went electronic without much regard to that persnickety rule. Mortgages and property titles are transferred several times in the process of a home purchase from originators to securitization sponsors to depositors to trusts. Trustees hold the note (which is the IOU on the mortgage), the mortgage (the security that says the house is collateral) and the assignment of the note and security instrument.

    The issue is in that final stage getting to the trust. The law demands that when the papers get moved around they are 'wet ink,' that is, real signatures on real paper. But Prof. Levin tells me that's not the worst of it. Affidavits assigned to the notes and security instruments are supposed to be endorsed over to the trust at the time of sale, but in many foreclosure scenarios the affidavits have been backdated illegally.  So with the chain of documentation now in question, and trustee ownership in question, here is one legal scenario, according to Prof. Levitin:

    The mortgage is still owed, but there's going to be a problem figuring out who actually holds the mortgage, and they would be the ones bringing the foreclosure. You have a trust that has been getting payments from borrowers for years that it has no right to receive. So you might see borrowers suing the trusts saying give me my money back, you're stealing my money. You're going to then have trusts that don't have any assets that have been issuing securities that say they're backed by a whole bunch of assets, and you're going to have investors suing the trustees for failing to inspect the collateral files, which the trustees say they're going to do, and you're going to have trustees suing the securitization sponsors for violating their representations and warrantees about what they were transferring.

    Josh Rosner, of Graham-Fisher, put the following out in a note today, claiming violations of pooling and servicing agreements on mortgages could dwarf the Lehman weekend:

    Nearly all Pooling and Servicing Agreements require that 'On the Closing Date, the Purchaser will assign to the Trustee pursuant to the Pooling and Servicing Agreement all of its right, title and interest in and to the Mortgage Loans and its rights under this Agreement (to the extent set forth in Section 15), and the Trustee shall succeed to such right, title and interest in and to the Mortgage Loans and the Purchaser's rights under this Agreement (to the extent set forth in Section 15)'. Also, an Assignment of Mortgage must accompany each note and this almost never happens. We believe nearly every single loan transferred was transferred to the Trust in 'blank' name. That is to say the actual loans were apparently not, as of either the cut-off or closing dates, assigned to the Trust as required by the PSA.  Rather than continue to fight for the 'put-back' of individual loans the investors may be able to sue for and argue that the 'true sale' was never achieved.  Quite the can
     of worms. Anyone who says that the banks will fix all this in a few months is seriously delusional."
