update HOA Attempts Eviction of Too-Large Family

If your neighbors show up and start counting your children, you might think they just are admiring your reproductive prowess. In one case in Florida, however, the neighbor was actually tallying up the offspring in order to attempt an eviction. In 2006, a Florida homeowners’ association (HOA) tried to evict a family from their town home for having too many residents. The home had four bedrooms and the family had six children in addition to the two parents living in the home. The family filed a discrimination complaint and the case is just now making headlines because seven years later, HUD is taking some action by charging the HOA with “discriminating against large families.” The rights violation falls under the portion of the Fair Housing Act that protects people from discrimination based on family status. The association and its management company face fines of up to $16,000, but both defendants claim that the suit took too long to file and that the rules were clearly stated in HOA covenants. In the meantime, the family split during a divorce, moved away, and several of the children are now grown. The family stayed through the end of its one-year lease after the HOA agreed not to evict until the HUD investigation was complete
